FANTASIA TERMS OF SERVICE & SUBSCRIPTION POLICY

1. ACCEPTANCE OF TERMS

By accessing or using Fantasia ("the Platform"), including our desktop application, mobile application, and cloud services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

2. SERVICE DESCRIPTION

Fantasia is an AI-powered tabletop role-playing game platform that connects Game Masters ("GMs") who provide game facilitation services with Players who join these games. The Platform provides:

  • For GMs: Tools to host games with AI-enhanced non-player characters using their own Claude Code subscriptions
  • For Players: Access to join and participate in GM-hosted games via mobile applications
  • Infrastructure: Cloud-based game state management, message routing, and session persistence

3. SUBSCRIPTION MODEL & MONETIZATION

3.1 GM Service Subscriptions

  • Optional Monetization: GMs may optionally charge subscription fees for their games
  • Subscription Scope: Subscriptions are per GAME (not per player or per session)
  • Pricing Control: GMs have complete control over pricing and subscription tiers

3.2 Purpose of GM Subscriptions

GM subscriptions compensate for:

  • Game facilitation services and expertise
  • Session preparation and worldbuilding time
  • AI infrastructure costs (Claude Code subscription)
  • Real-time narrative improvisation
  • Technical hosting and platform maintenance
  • Custom content creation

3.3 Revenue Distribution

  • GM Share: 70% of subscription revenue
  • Platform Fee: 30% retained by Fantasia for platform services

3.4 Platform Subscription (Fantasia Premium)

Free Tier (Launch Version)

At launch, Fantasia is free to use with the following limitations:

  • 1 Game per GM account: Each GM can create and host one game
  • Full Player Access: Unlimited players can join games
  • Core Features: All essential platform features included

Premium Tier

Price: €9.95/month (including VAT)

Fantasia Premium unlocks advanced features:

  • Epic Familiar: Enhanced AI assistant with advanced capabilities
  • Unlimited Games: Create and host multiple games simultaneously
  • Dice Reroll: Ability to reroll dice in critical moments
  • Premium Rank Badge: Visual distinction in the community
  • Priority Support: Faster response times for support requests

3.5 Payment Terms & Billing

3.5.1 Payment Processing

  • All payments are processed securely through Stripe, Inc.
  • We do not store your full credit card information
  • You authorize us to charge your payment method for all fees incurred
  • Payment information is subject to our Privacy Policy

3.5.2 Subscription Billing Cycles

Fantasia Premium:

  • Billed monthly on the same day you subscribed
  • Automatically renews unless cancelled before billing date
  • Charges appear as "Fantasia Premium" or "FineApps" on statements

GM Subscriptions:

  • Billed monthly per game subscription
  • Prices set by GMs are VAT-inclusive (GMs should set final prices players will pay)
  • Each game subscription renews independently
  • Charges appear as "Fantasia - [Game Name]" on statements

3.5.3 Failed Payments

If a payment fails:

  • We will attempt to retry the charge up to 3 times over 7 days
  • You will receive email notifications for each failed attempt
  • For Fantasia Premium: Your account will revert to Free tier if payment cannot be collected
  • For GM Subscriptions: Your game access will be suspended until payment is resolved
  • You remain responsible for any outstanding fees

3.5.4 Taxes

  • All prices shown include applicable VAT for EU customers
  • For Greek customers: Displayed prices include 24% VAT
  • For other EU customers: Prices include VAT at your country's rate
  • Non-EU customers: Prices shown do not include local sales tax (if applicable)
  • Tax rates are determined by Stripe based on your billing address
  • You are responsible for any additional local taxes not collected by Stripe

3.6 Refund Policy

3.6.1 EU Consumer Rights (14-Day Cooling Off Period)

If you are located in the European Union, you have the right to withdraw from your purchase within 14 days without giving any reason, pursuant to the EU Consumer Rights Directive (2011/83/EU).

To exercise your right of withdrawal:

  • Email us at info@fineapps.gr within 14 days of purchase
  • Subject line: REFUND REQUEST - [Subscription Type]
  • Include: Your account email, purchase date, and reason (optional)

Important: By subscribing and immediately accessing digital content (Epic Familiar, Premium features, or paid games), you acknowledge that you are expressly requesting immediate access and thereby waiving your 14-day withdrawal right for that billing period. However, you may still cancel future recurring charges at any time.

3.6.2 Refund Eligibility

Fantasia Premium:

  • First 14 days (EU users): Full refund available if you have not accessed Premium features
  • After 14 days or after using features: No refunds, but you may cancel to stop future charges
  • Partial month usage: No pro-rated refunds for unused portions of the billing period

GM Subscriptions:

  • First 14 days (EU users): Full refund if you have not accessed the game
  • After accessing the game: Refunds are at GM's discretion
  • GM-initiated refunds: GMs may issue refunds through their dashboard
  • Platform fee retained: When GM issues refund, Fantasia's 30% platform fee is non-refundable

3.6.3 Exceptional Circumstances

Refunds may be granted outside normal policy for:

  • Technical issues preventing service access (verified by our support team)
  • Unauthorized charges (requires investigation)
  • GM cancels game before content is delivered
  • Other exceptional cases at Fantasia's sole discretion

3.6.4 Refund Processing

  • Approved refunds are processed within 5-10 business days
  • Refunds return to original payment method
  • Bank processing may take additional 3-5 business days
  • You will receive email confirmation when refund is issued

3.7 Subscription Management & Cancellation

3.7.1 How to Cancel

Fantasia Premium:

  • Go to Dashboard → Settings → Subscription
  • Click "Cancel Subscription"
  • Confirm cancellation
  • Alternative: Email info@fineapps.gr with subject "CANCEL PREMIUM"

GM Subscriptions:

  • Go to Game Page → Subscriptions → Manage
  • Click "Cancel Subscription" for specific game
  • Confirm cancellation
  • Alternative: Email info@fineapps.gr with subject "CANCEL GAME - [Game Name]"

3.7.2 Cancellation Effect

  • Immediate: No further charges will be made
  • Access continues: You retain access until end of current billing period
  • No pro-rated refunds: You will not be refunded for the remaining days
  • Data retained: Your account data is preserved if you resubscribe

3.7.3 Resubscribing

  • You may resubscribe at any time
  • Previous data and settings are restored
  • New billing cycle starts immediately
  • Prior promotional rates may not apply

3.7.4 Automatic Renewal Disclosure

IMPORTANT - AUTO-RENEWAL TERMS: By subscribing, you authorize us to automatically charge your payment method each billing period until you cancel. You will receive email reminders before each renewal. You may cancel at any time to stop future charges. This complies with FTC Auto-Renewal Rules and applicable state laws.

3.8 Price Changes & Notifications

3.8.1 Fantasia Premium Price Changes

  • We may change Fantasia Premium pricing with 30 days advance notice
  • Notice will be sent via email and in-app notification
  • Current subscribers will be grandfathered at existing rate for 3 months
  • After grace period, new pricing applies unless you cancel
  • You may cancel before new pricing takes effect without penalty

3.8.2 GM Subscription Price Changes

  • GMs may change their game pricing with 30 days notice to subscribers
  • Current subscribers must be notified via game announcement and email
  • Existing subscribers may continue at old rate until they cancel, or accept new rate
  • New subscribers pay the updated rate immediately

3.8.3 Platform Fee Changes

  • Changes to the 70/30 revenue split require 90 days notice to GMs
  • Existing games are grandfathered at current split for 6 months minimum
  • GMs may adjust their pricing or withdraw from paid subscriptions in response

3.9 Free Trials

3.9.1 Trial Eligibility

  • Free trials are available for first-time Fantasia Premium subscribers only
  • One free trial per user account
  • Valid payment method required to start trial
  • Not available to users who previously subscribed

3.9.2 Trial Terms

  • Trial duration will be clearly stated at sign-up (typically 7-14 days)
  • Full access to all Premium features during trial
  • You may cancel during trial without charge
  • If not cancelled, you will be automatically charged at the end of trial period

3.9.3 Trial Notifications

  • You will receive email notification 3 days before trial ends
  • Reminder includes cancellation instructions
  • Dashboard displays remaining trial days

3.9.4 GM Free Sessions

  • GMs may offer free "trial sessions" for their paid games at their discretion
  • These are not formal trials and have no automatic conversion
  • Players must manually subscribe after free access period ends

3.10 GM Payouts & Tax Documentation

3.10.1 Payout Schedule

  • GM earnings are calculated monthly (70% of gross game subscription revenue)
  • Payouts processed within 15 business days after month end
  • Minimum payout threshold: €50 accumulated earnings
  • If below threshold, earnings roll over to next month

3.10.2 Payout Methods

  • Bank transfer (SEPA for EU, international wire for others)
  • PayPal (where available)
  • Stripe Express payouts (GMs must complete Stripe Connect onboarding)
  • Payment method must be configured in GM Dashboard → Payouts

3.10.3 Tax Responsibility

GMs are independent contractors, not employees. You are solely responsible for:

  • Reporting all income from GM subscriptions to tax authorities
  • Paying applicable income tax, VAT, or sales tax in your jurisdiction
  • Maintaining records of your earnings and expenses
  • Consulting with tax professionals regarding your obligations

Fantasia does not withhold taxes from GM payouts. We may provide earnings summaries for your records, but these are not official tax documents.

3.10.4 Tax Forms & Compliance

For GMs in the United States:

  • You must provide W-9 or W-8 forms if earnings exceed $600 USD annually
  • We will issue Form 1099-K or 1099-NEC as required by IRS regulations
  • Failure to provide tax documentation may result in backup withholding (24%)

For GMs in the European Union:

  • Provide VAT registration number if you are VAT-registered
  • You are responsible for charging and remitting VAT on your services if applicable
  • We may be required to report your earnings to EU tax authorities under DAC7 (Platform Reporting Directive)

3.10.5 Payout Disputes

  • Review your earnings in GM Dashboard → Revenue Report before disputing
  • To dispute a payout calculation, email info@fineapps.gr with subject "PAYOUT DISPUTE - [Month/Year]"
  • Include: Your GM account email, disputed month, expected vs actual amount, and explanation
  • We will investigate and respond within 10 business days

3.10.6 Withholding for Chargebacks & Refunds

  • If a player requests refund, GM's share (70%) will be deducted from next payout
  • For chargebacks, both GM share and platform fee are deducted, plus chargeback fee (typically €15-25)
  • Excessive chargebacks may result in payout holds or account suspension
  • Reserve funds: We may hold up to 10% of monthly revenue in reserve for 30 days to cover potential refunds/chargebacks

3.11 Subscription Forfeiture Upon Ban

If your account is suspended or terminated for violation of these Terms, including but not limited to Young Adult content policy violations (see Section 6.6.4):

  • Access revoked immediately: You lose access to all Platform features upon ban
  • No refund: You will not be refunded for remaining subscription time (days or months)
  • Applies to all subscriptions: This includes both monthly and annual Fantasia Premium subscriptions
  • Advance warning: Users who violate YA content policies are warned of this consequence prior to any ban

This forfeiture policy is consistent with industry standard practices (e.g., Netflix, Spotify, Discord) and reflects the seriousness with which we treat violations of our child safety policies.

4. EXTERNAL SERVICES & CLAUDE CODE

4.1 Claude Code Subscriptions

  • Claude Code subscriptions are purchased directly from Anthropic
  • Fantasia does not sell, resell, or receive any compensation from Claude Code subscriptions
  • GMs are solely responsible for maintaining their own Claude Code subscriptions
  • Fantasia provides integration tools but no AI compute services

4.2 GM Responsibilities

GMs using the Platform must:

  • Maintain active Claude Code subscriptions for AI features
  • Ensure adequate token allowances for their games
  • Comply with Anthropic's Terms of Service
  • Not share Claude Code credentials with other users

5. INTELLECTUAL PROPERTY & CONTENT

5.1 User Content Responsibility

If you create or share content on Fantasia (including Game Systems, characters, worlds, or game materials), you are responsible for:

  • Ensuring you have the right to post that content
  • Ensuring you have the right to grant the licenses in Section 5.3
  • Ensuring your content is lawful and does not infringe third-party rights

We take no responsibility for any of your content, and we are not responsible for others' use of your content.

5.2 Platform Role

Fantasia operates as a hosting platform where users create and share content. We provide tools and infrastructure but do not:

  • Create, author, or publish user content
  • Review or approve Game Systems before publication
  • Act as publisher or distributor of user materials
  • Endorse or verify user-created content
  • Monitor content for intellectual property violations

We have the right, but not the obligation, to review and remove content that violates these Terms or applicable law.

5.3 Content License

By posting content on Fantasia, you grant us a license to store, display, and transmit your content as necessary to operate the service. This license is limited to operating the Platform and does not give us ownership of your content.

  • GMs retain ownership of original worlds, campaigns, and characters they create
  • Players retain ownership of their character concepts and contributions

5.4 Third-Party Materials

Players are responsible for owning any required game materials (rulebooks, supplements) to participate in games. The Platform does not provide or distribute copyrighted game content.

5.5 Derivative Works Based on Existing Intellectual Property

Users may create worlds and game systems based on existing intellectual property if they have proper authorization. Proper authorization includes:

  • Official license or permission from the rights holder
  • Content available under open licenses (Creative Commons, OGL, etc.)
  • Use that qualifies as fair use for personal/educational purposes
  • Public domain works

By indicating that your content is based on existing IP, you represent and warrant that:

  • You have the legal right to create derivative works based on that IP
  • You will not hold Fantasia responsible for verifying your authorization
  • You are solely responsible for ensuring your use is lawful
  • You agree to indemnify Fantasia for any claims arising from your derivative works (see Section 13)

Fantasia does not adjudicate intellectual property disputes or determine whether your use constitutes fair use.We respond to valid DMCA notices and may remove content that violates third-party rights.

5.6 Platform Intellectual Property

  • Fantasia, AISATNAF, and associated logos are trademarks of Fantasia/FineApps
  • The Platform's software, design, and systems are proprietary
  • Users may not reverse-engineer or copy Platform functionality

6. USER CONDUCT & GUIDELINES

6.1 GM Guidelines

GMs agree to:

  • Provide games as advertised
  • Maintain consistent schedules
  • Treat players respectfully
  • Not misrepresent subscription benefits
  • Clearly communicate what subscription tiers include

6.2 Player Guidelines

Players agree to:

  • Respect GM's time and effort
  • Participate constructively in games
  • Not disrupt gameplay intentionally
  • Honor subscription commitments

6.3 Prohibited Activities

  • Harassment, hate speech, or discrimination
  • Sharing copyrighted materials without authorization
  • Attempting to circumvent Platform security
  • False advertising or misrepresentation
  • Account sharing or credential trading
  • Posting inappropriate content in games marked as "suitable for minors" (see Section 6.6)
  • Falsely marking games as YA-safe to attract minor users

6.4 Reporting Intellectual Property Violations

Users can report suspected IP violations to info@fineapps.gr with subject line: Subject: ABUSE - [description]

Include: System name, rights holder, evidence of infringement

We will investigate reports and may request documentation from system creator, temporarily suspend system pending review, permanently remove infringing content, or terminate accounts of repeat infringers.

We are not obligated to investigate all reports and reserve the right to determine appropriate action. Submitting false or malicious reports may result in account termination.

6.5 Payment Disputes & Chargebacks

6.5.1 Contact Us First

Before filing a chargeback with your bank, please contact us at info@fineapps.gr with subject line:Subject: PAYMENT DISPUTE - [description]

Most payment issues can be resolved quickly through:

  • Refund processing (if eligible under Section 3.6)
  • Billing error correction
  • Subscription cancellation assistance
  • Account access troubleshooting

6.5.2 Chargeback Policy

Filing a chargeback without first contacting us may result in:

  • Immediate account suspension pending dispute resolution
  • Chargeback fee (€15-25) added to your account balance
  • Loss of access to all purchased content and subscriptions
  • Permanent ban if chargeback is deemed fraudulent

6.5.3 Legitimate Chargeback Reasons

We recognize chargebacks are appropriate for:

  • Unauthorized charges (stolen card, account hacked)
  • Billing errors (charged wrong amount, duplicate charges)
  • Service not provided after payment
  • Technical issues preventing access that we failed to resolve

If your chargeback is legitimate, contact us with documentation and we will cooperate with the investigation.

6.5.4 Fraudulent Chargeback Protection

Filing a chargeback after receiving services constitutes fraud. We will:

  • Provide evidence of service delivery to payment processor
  • Submit access logs, subscription history, and usage data
  • Permanently ban accounts that commit chargeback fraud
  • Report repeat offenders to payment processors and fraud prevention services

6.5.5 GM Subscription Disputes

For disputes related to GM-hosted games:

  • Contact the GM first via game chat or email (if provided)
  • Request refund from GM if you believe service was not provided as advertised
  • Contact Fantasia support if GM is unresponsive or dispute is unresolved
  • Provide evidence: Screenshots, chat logs, game descriptions, dates of service interruption

We will investigate and may issue refund, transfer you to another game, or mediate resolution with GM. However, we are not responsible for GM service quality and cannot guarantee outcomes.

6.5.6 Dispute Resolution Timeframe

  • Payment dispute inquiries: Response within 2 business days
  • GM subscription disputes: Response within 5 business days
  • Chargeback investigations: Response within 10 business days
  • Complex cases: May take up to 30 days for full resolution

6.6 Young Adult (YA) Game Content

Games can be marked as "suitable for minors" to allow users with YA Protection enabled to access them. GMs who mark games as YA-safe accept additional responsibilities:

6.6.1 GM Responsibilities for YA Games

  • Content appropriateness: Ensure all game content is genuinely suitable for minors
  • Ongoing compliance: Maintain appropriate content throughout the game's lifecycle
  • Accurate marking: Do not falsely mark games as YA-safe to attract players
  • Respond to violations: Address any content violations promptly when notified

6.6.2 Automated Content Enforcement

Games marked as "suitable for minors" are subject to automated content scanning:

  • AI analysis: Our Herodotus system periodically scans game content
  • Categories checked: Violence, sexual content, substance abuse, hate speech, self-harm, and profanity
  • Automatic lockdown: Games with violations are automatically hidden from players until fixed
  • GM notification: GMs see a violation banner with specific issues and recommendations
  • Re-verification: GMs can request re-scan after fixing content

6.6.3 Prohibited Content in YA Games

The following content is prohibited in games marked for minors:

  • Graphic violence, gore, or torture
  • Sexual themes or explicit content
  • Drug use or substance abuse
  • Discriminatory or hateful language
  • Self-harm or suicide themes
  • Excessive profanity

6.6.4 Consequences for Violations

Game Consequences (every violation):

  • Game is locked until GM fixes content and requests re-verification

User Consequences (escalating):

  • First violation: Warning notification sent to user via private message
  • Second violation: Account suspended for one week; a warning badge becomes visible on your profile to Game Masters and Young Adult accounts; Game Masters can view your violation history to make informed decisions; any active subscription is forfeited (see Section 3.11)
  • Third violation: Permanent account ban; any active subscription is forfeited (see Section 3.11); depending on the nature of the violations, further action may be taken
  • False marking: Deliberately marking inappropriate games as YA-safe may result in immediate permanent ban

7. PRIVACY & DATA PROTECTION

8. AGE REQUIREMENTS & YOUNG ADULT PROTECTION

8.1 Minimum Age

  • Minimum age: You must be at least 13 years old to use Fantasia
  • Under 18: Users under 18 must have parental or guardian consent
  • Under 13: Accounts for users under 13 will be terminated if discovered

8.2 Young Adult (YA) Protection Mode

Users who are minors (or wish to use enhanced privacy) can enable YA Protection Mode:

  • Location: Settings > System tab > "Are you a young adult?"
  • Self-identification: This is voluntary; we do not verify age
  • Reversible: Can be disabled at any time in Settings

8.3 Effects of YA Protection Mode

When enabled, YA Protection Mode provides maximum account protection:

  • Privacy tab locked: Privacy settings are greyed out and cannot be changed
  • Profile hidden: Your profile is hidden from non-friends
  • Messaging restricted: Only you can initiate conversations
  • Friend requests blocked: Only you can send friend requests
  • AI personalization disabled: Herodotus player analysis is turned off
  • Game access restricted: You can only see and join games marked as "suitable for minors"
  • YA badge displayed: A green "YA" badge appears next to your display name

8.4 Parental Guidance

Parents and guardians are encouraged to enable YA Protection Mode on their child's account. Even with YA Protection enabled, parental supervision of online activities is recommended. Contact info@fineapps.gr for parental concerns (Subject: PARENTAL REQUEST).

9. BETA SOFTWARE NOTICE

Fantasia is currently in beta. This means:

  • Features may change without notice
  • Temporary service interruptions may occur
  • Data loss is possible (though we work to prevent it)
  • Bugs and issues are expected

10. DISCLAIMERS & LIMITATIONS OF LIABILITY

10.1 Service Disclaimers

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 Content Disclaimers

We do not:

  • Endorse or verify the accuracy, legality, or safety of user content
  • Review or approve content before publication
  • Monitor for intellectual property violations
  • Guarantee that user content complies with applicable law

10.3 User Content Responsibility

Users are solely responsible for ensuring their content is lawful and does not infringe third-party rights.

10.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FANTASIA'S TOTAL LIABILITY SHALL NOT EXCEED THE LESSER OF:

  • (a) Platform fees collected from you in the past 2 months, OR
  • (b) €100 (one hundred euros)

This applies to all claims including negligence, breach of contract, and intellectual property claims.

11. GOVERNING LAW

These Terms are governed by the laws of Greece without regard to conflict of law principles.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless FineApps, Fantasia, and their officers, directors, employees, and agents from and against any claims, liabilities, damages, and costs (including reasonable legal and accounting fees) related to:

  • (a) Your access to or use of our services or third-party services
  • (b) Your content (including Game Systems, characters, and game materials)
  • (c) Your violation of these Terms
  • (d) Your negligence or willful misconduct

This indemnification survives termination of your account.

14. DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA)

14.1 DMCA Policy

Fantasia respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512).

14.2 Notice of Infringement

If you believe content on Fantasia infringes your copyright, send written notice to:

Your notice must include:

  • Physical or electronic signature of copyright owner or authorized agent
  • Identification of copyrighted work claimed to be infringed
  • Identification of infringing material and its location on the Platform
  • Your contact information (address, phone, email)
  • Statement of good faith belief that use is unauthorized
  • Statement under penalty of perjury that information is accurate and you're authorized to act

14.3 Counter-Notification

If your content was removed due to DMCA notice, you may file a counter-notification to info@fineapps.gr with subject line:Subject: DMCA COUNTER - [description]

Counter-notification must contain:

  • Your physical or electronic signature
  • Identification of removed material and its prior location
  • Statement under penalty of perjury that removal was mistake or misidentification
  • Your name, address, phone number
  • Consent to jurisdiction of Federal District Court

14.4 Repeat Infringer Policy

Users who repeatedly infringe copyrights will have their accounts terminated.

14.5 No Obligation to Monitor

We do NOT actively monitor user content for copyright infringement and are not responsible for user-uploaded content.
