FALL OF PENTAPOLIS — TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By downloading, accessing, or playing Fall of Pentapolis ("the Game"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not play the Game.

The Game is provided by Dimitrios Daskaleas d/b/a FineApps ("we," "us," or "our"). You must be at least 13 years old (or the minimum digital-consent age in your country) to play. By playing, you represent that you meet this requirement.

2. DESCRIPTION OF SERVICE

Fall of Pentapolis is a free-to-play, online co-op beat-'em-up with RPG progression, set in the dark-fantasy Kingdom of Light universe. It provides:

• Single-player and online co-op gameplay for up to three players
• Character progression, unlockable heroes, items, and trophies
• Friends, leaderboards, and daily rewards

The Game is free to download and play. It also offers optional in-app purchases — a virtual currency called Game Points (GP), which are never required to play or finish the Game. All real-money purchases are processed through the app store you downloaded the Game from — Google Play on Android, the Apple App Store on iOS. See Section 5 for the full purchase terms.

3. YOUR ACCESS, ACCOUNT & NICKNAME

The Game does not require a traditional login — there is no email or password. Your progress is anchored to an anonymous identifier and stored on our servers. You are responsible for the device you play on and for activity that occurs through it.

Keeping your progress across devices. So that you do not lose your progress when you reinstall the Game or change phones, we provide two optional, anonymous account-portability features:

• Platform sign-in — linking to your Apple Game Center (iOS) or Google Play Games (Android) identity, which lets the Game recognise you automatically on your other devices. No email or password is shared with us.
• Recovery code — an anonymous code you can view in Settings → Account and enter on another device to restore your progress.

Using these features is optional but strongly recommended. You are responsible for keeping your recovery code private — anyone who has it can restore your progress onto their device. We are not responsible for progress lost because account-portability features were not set up, or for misuse of a recovery code you disclosed.

Your chosen nickname must NOT:

• Impersonate another person or entity
• Contain offensive, hateful, vulgar, or inappropriate content
• Infringe any trademark or other intellectual-property right
• Mislead other players about your identity

We may reset or reclaim nicknames that violate these rules.

4. PLAYER CONDUCT

When playing — especially in co-op and chat — you agree NOT to:

• Harass, threaten, or abuse other players
• Post or transmit offensive, defamatory, or unlawful content
• Cheat, exploit bugs, or use mods, bots, or tools that give an unfair advantage
• Tamper with, reverse-engineer, or attempt to manipulate the Game or its servers
• Disrupt co-op sessions or other players' experience
• Attempt to access other players' data or accounts
• Use the Game for any illegal or unauthorized purpose

We may suspend or terminate access for conduct that violates these Terms.

Moderation & safety. Chat is automatically filtered for offensive language. You can block any player (hiding their chat and keeping them out of your co-op games) and report abusive behaviour from the co-op roster. We review reports and may act on violations. Blocking and reporting tools are provided for your safety; misuse of the report system (e.g. false reports) is itself a violation of these Terms.

5. PURCHASES, GAME POINTS & VIRTUAL ITEMS

5.1 Game Points (Virtual Currency)

• No real-world value — Game Points (GP), in-game items, levels, and unlocks are virtual, have no monetary value, and cannot be exchanged for real money or transferred, sold, or traded outside the Game.
• License, not ownership — GP and virtual items are licensed to you for personal use within the Game; you do not own them.

5.2 Buying Game Points (In-App Purchases)

• You may buy GP packs with real money through the app store you downloaded the Game from — Google Play on Android, the Apple App Store on iOS. That store processes the payment; we never receive or store your payment-card details.
• Each purchase is also governed by the terms and payment policies of the store you bought it from — the Google Play Terms of Service, or Apple's App Store Terms of Service and Media Services Terms.
• GP is credited to your in-game balance once the store confirms and our server verifies the purchase.

5.3 Refunds

• Except where required by law, all purchases are final and non-refundable once the GP is delivered to your account.
• Refund requests for store purchases are handled by Google Play or Apple under their own refund policies — we cannot issue store refunds ourselves. Because GP is delivered immediately, it is treated as consumed on delivery.

5.4 Randomized Items

• The "Random Item" purchase spends GP to grant a randomly selected item of the rarity tier you choose (Normal, Rare, or Epic). The specific item you receive is determined by chance and is not guaranteed.
• The relative chances of the possible outcomes are described within the Game and/or its store listing. By making a randomized purchase, you acknowledge and accept that the outcome is random.

5.5 Promotional Offers

• We may run limited-time or one-time promotions, such as the new-player welcome offer. These are available only for the stated period and on the stated terms, cannot be combined with other offers, and may be changed or withdrawn at any time.

5.6 Changes & Loss

• Prices, contents, and availability of GP packs and items may change at any time.
• For balance, security, legal, or technical reasons we may modify, remove, or reset virtual items, GP, or progression.
• Your progress is stored on our servers and can be restored using the account-portability features in Section 3 (platform sign-in or your recovery code). However, if you have not linked an account or saved your recovery code, GP and items may be lost if you uninstall the Game, reset your device, or lose your device identifier, and we are not liable for such loss. Unused GP and items are forfeited if your access is terminated for violating these Terms.

5.7 Minors & Spending

• If you are under the age of majority where you live, you may make purchases only with the consent of your parent or guardian and the account holder.
• The account holder is responsible for all purchases made on their device. We recommend enabling purchase authentication and parental spending controls — in Google Play on Android, or in Screen Time ("Ask to Buy" / Content & Privacy Restrictions) on iOS.

6. INTELLECTUAL PROPERTY

The Game, including its code, art, characters, story, music, the Kingdom of Light setting, and the Fall of Pentapolis name and logo, is owned by us or our licensors and protected by intellectual-property laws. You receive a limited, personal, non-exclusive, non-transferable, revocable license to play the Game for your own non-commercial entertainment. You may not copy, modify, distribute, sell, or create derivative works from any part of the Game without our written permission.

7. PRIVACY

Your use of the Game is also governed by our Privacy Policy. Key points: we collect only what is needed to run the Game, we do not sell your data, the Game contains no ads, and you can request deletion of your data.

8. AVAILABILITY & CHANGES

The Game is an evolving online service. We may update, change, suspend, or discontinue any part of it (including features, servers, or the Game itself) at any time, with or without notice. We do not guarantee uninterrupted or error-free operation.

9. DISCLAIMERS

The Game is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Game will be uninterrupted, secure, error-free, or free of harmful components.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law, we shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of progress, virtual items, or data
• Conduct of other players
• Any amount exceeding what you paid us (if anything) in the prior 6 months

11. TERMINATION

You may stop playing and delete the Game at any time. We may suspend or terminate your access if you violate these Terms, cheat, abuse other players, or harm the service. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) will continue to apply.

12. GOVERNING LAW

These Terms are governed by the laws of Greece, without regard to conflict-of-law principles.

13. ADDITIONAL TERMS FOR APPLE APP STORE DOWNLOADS

The following applies only if you obtained the Game from the Apple App Store, and prevails over anything inconsistent elsewhere in these Terms for those downloads. In this section, "Apple" means Apple Inc. and its subsidiaries.

• This agreement is with us, not Apple. These Terms are concluded between you and Dimitrios Daskaleas d/b/a FineApps only — not with Apple. We, not Apple, are solely responsible for the Game and its content.
• Scope of licence. Your licence to use the Game is a non-transferable licence to use it on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Maintenance and support. We are solely responsible for providing any maintenance and support for the Game. Apple has no obligation whatsoever to furnish any maintenance or support services.
• Warranty. To the maximum extent permitted by applicable law, Apple has no warranty obligation with respect to the Game. If the Game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the Game to you. Apple has no other warranty obligation whatsoever with respect to the Game; any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our sole responsibility.
• Product claims. We, not Apple, are responsible for addressing any claims relating to the Game or your possession and use of it, including product-liability claims, any claim that the Game fails to conform to a legal or regulatory requirement, and claims arising under consumer-protection, privacy or similar legislation.
• Intellectual-property claims. If a third party claims that the Game or your possession and use of it infringes that third party's intellectual-property rights, we, not Apple, are solely responsible for the investigation, defence, settlement and discharge of that claim.
• Legal compliance. You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-party terms. You must comply with any applicable third-party terms of agreement when using the Game.
• Apple as third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
• Contact. Questions, complaints or claims about the Game should be directed to fallofpentapolis@fineapps.gr.

14. CHANGES TO THESE TERMS

We may modify these Terms as the Game evolves. Material changes will be announced in-game or on this page with an updated date. Continued play after changes take effect constitutes acceptance.
