1. Acceptance of Terms

By accessing or using Bandy ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

The Service is provided by Dimitrios Daskaleas d/b/a FineApps ("we," "us," or "our"). You must be at least 13 years old to use Bandy. By using the Service, you represent that you are at least 13 years of age.

2. Description of Service

Bandy is a free musician collaboration platform that provides:

• Band formation and management tools
• Rehearsal scheduling and coordination
• Song suggestion and playlist management
• Messaging and communication features

All core features are free to use. Optional premium features may be offered in the future for enhanced functionality, but will never limit access to the free features listed above.

3. Account Registration

3.1 Account Creation

To use Bandy, you must create an account using a valid email address. You are responsible for:

• Providing accurate and complete information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Updating your information to keep it current

3.2 Stage Names

Your stage name must not:

• Impersonate another person or entity
• Contain offensive, vulgar, or inappropriate content
• Violate any trademark or intellectual property rights
• Mislead other users about your identity

4. User Conduct

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Harass, abuse, or harm other users
• Post content that is offensive, defamatory, or inappropriate
• Spam or send unsolicited messages to other users
• Attempt to gain unauthorized access to other accounts
• Use automated systems or bots without permission
• Violate any applicable laws or regulations
• Share copyrighted material without proper authorization

5. Content Ownership and Rights

5.1 Your Content

You retain ownership of all content you post on Bandy, including:

• Profile information
• Songs and playlists
• Messages and communications
• Schedule data

By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and distribute your content solely for the purpose of operating and improving the Service.

5.2 Our Content

The Bandy platform, including its design, features, and functionality, is owned by us and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service.

5.3 Spotify Integration

Song data retrieved through Spotify integration is subject to Spotify's terms of service. We do not claim ownership of any Spotify content.

6. Free and Premium Services

6.1 Free Core Features

Bandy's core features will always remain free, including:

• Creating and joining bands
• Band management and scheduling
• Song suggestions and playlists
• Messaging and communication
• Basic profile features

We are committed to keeping these essential collaboration tools free forever.

6.2 Optional Premium Features (Future)

We may introduce optional premium features for enhanced functionality:

• Musician discovery and search
• Advanced musician matching
• Additional customization options
• Priority support
• Extended features beyond core collaboration

7. Band Management

7.1 Band Leaders

Band leaders have special privileges including:

• Managing band membership
• Configuring song slots
• Controlling playlists
• Transferring leadership

Leaders must exercise these privileges responsibly and in good faith.

7.2 Band Members

By joining a band, you agree to:

• Respect band rules and decisions
• Participate constructively
• Not disrupt band activities
• Accept removal by band leader if necessary

8. Communication Features

8.1 Messaging

All messages must comply with our community guidelines. We do not monitor private messages but may investigate reported violations.

8.2 Red Flag System

The red flag system helps bands manage their song choices by:

• Allowing members to mark songs they cannot play
• Showing which songs have red flags from band members
• Helping bands choose songs everyone can perform

9. Privacy and Data Protection

Your use of Bandy is also governed by our Privacy Policy. Key points:

• We collect only necessary data to provide the Service
• We do not sell your personal information
• We use industry-standard security measures
• You control your data and can request deletion

10. Disclaimers and Limitations

10.1 Service Availability

Bandy is provided "as is" without warranties of any kind. We do not guarantee:

• Uninterrupted service availability
• Error-free operation
• Compatibility with all devices
• Success in finding band members or collaborations

10.2 User Interactions

We are not responsible for:

• Disputes between band members
• Failed collaborations or rehearsals
• User behavior offline
• Content posted by users

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits or opportunities
• Data loss or corruption
• Damages exceeding the amount you paid us in the past 2 months

12. Modifications

Continued use after changes constitutes acceptance.

13. Termination

13.1 By You

You may terminate your account at any time through account settings. Upon termination:

We may suspend or terminate accounts that:

• Violate these Terms
• Remain inactive for extended periods
• Engage in fraudulent activity
• Harm the community

These Terms are governed by the laws of Greece, without regard to conflict of law principles.
